ADHD PIVOT LLC

PRIVACY POLICY

Effective Date: October 12, 2026 | https://www.adhdpivot.com

1. Company and Acceptance

These Website Terms and Conditions (“Terms”) govern the website at https://www.adhdpivot.com (the “Site”) and online purchases offered by ADHD Pivot LLC, a New Jersey limited liability company (“Company,” “we,” “us,” or “our”). By accessing the Site, you agree to the Terms applicable to website use. A purchase requires affirmative acceptance of the purchase terms presented before payment. Participation in coaching additionally requires a separately signed Digital Program & Coaching Services Agreement (“Services Agreement”). If you do not agree, do not use the Site or purchase services.

2. Three Separate Services and Eligibility

Company offers three distinct, separately purchased services: (a) a self-paced digital educational program addressing ADHD-related executive function skills that includes scheduled group coaching as described in the purchase offer (“Digital Program”); (b) a prepaid four-session individual coaching package; OR (c) a standalone individual coaching session. Each purchase provides only the expressly identified service. The Digital Program does not include individual coaching, and individual coaching purchases do not include the Digital Program or group coaching, unless expressly stated in a specific written offer. Coaching participants must be at least 18 years old. Service scope, access duration, included group calls, session length, package expiration and scheduling details will be disclosed in the offer and applicable Services Agreement.

3. Educational Nature; No Medical or Academic Services

Company provides educational instruction, executive function strategies, organization and planning support, and accountability. Company does not provide therapy, mental health counseling, diagnosis, medical treatment, medication management, emergency response, disability determinations or academic tutoring. Clients should seek appropriately licensed or qualified professionals for those needs. No healthcare provider–patient relationship is created.

4. Purchases, Payment and Installments

Prices, selected services, applicable taxes if any, and payment terms are disclosed before purchase and reflected in the order confirmation and/or Services Agreement. Website payments are processed by Stripe or its applicable payment services. Company does not represent that it stores complete payment card numbers. Where offered, installments are payments toward a specified purchase, not automatic subscriptions unless expressly described otherwise. Purchasers authorize only the charges disclosed and accepted in the payment process. Company may suspend access for unpaid amounts as permitted by the signed Services Agreement and law. There is no automatic renewal unless expressly disclosed and separately authorized.

5. Refunds, Cancellations and Scheduling

ALL SALES ARE INTENDED TO BE FINAL AND NONREFUNDABLE, EXCEPT AS REQUIRED BY APPLICABLE LAW OR EXPRESSLY PROVIDED IN THE SIGNED SERVICES AGREEMENT. The policy is disclosed before purchase. Failure to access materials, complete lessons, attend available sessions, or achieve an expected outcome does not itself create a refund right. Any remedies for Company’s material breach, fraud, failure to deliver purchased services, or statutory rights remain available as applicable. Individual-session cancellation, missed appointments, rescheduling, package expiration and termination are governed by the signed Services Agreement. A stated session cancellation policy does not alter nonwaivable legal rights.

6. Program Access and Account Security

Digital Program access begins and ends according to the period specified at purchase. Access is licensed to the enrolled student, not the payer or household. Clients must maintain account credential confidentiality and promptly report suspected unauthorized use. Sharing accounts or enabling another person to access lessons is prohibited. Company may suspend access for material misuse, security risks or nonpayment in accordance with the Services Agreement and applicable law. Company may make reasonable changes to hosting or delivery without materially diminishing purchased services.

7. Intellectual Property and Prohibition on Sharing

All original course videos, audio, slides, lessons, downloadable worksheets, templates, exercises, graphics, branding, frameworks, and other content (“Materials”) are owned by Company or its licensors and protected by applicable intellectual property laws. Purchase grants only a limited, personal, nonexclusive, nontransferable, nonsublicensable license for the enrolled participant’s own educational use during the applicable access period. Without prior written permission, no one may share account credentials; give others access to Materials; copy, download beyond expressly permitted downloads, screen-record, photograph, reproduce, republish, upload, transmit, distribute, sell, sublicense, teach from, or commercially exploit Materials; or remove proprietary notices. Authorized personal downloads remain subject to these restrictions. Company may pursue legally available remedies for infringement and material breach.

8. Group Coaching Confidentiality and Conduct

Group coaching is included only with the Digital Program as described in the purchased offer. Participants must respect others’ privacy. Except with the affected person’s prior written consent or where disclosure is legally protected or required, participants may not identify other attendees or disclose their personal information, experiences, statements or discussions to third parties; nor may they record, photograph, screenshot, publish or post group sessions or participant information on social media. No harassment, threats, discriminatory abuse or disruptive conduct is permitted. Company may remove participants for material misconduct, consistent with the Services Agreement and law. Company will take reasonable steps regarding information within its control but cannot guarantee that independent participants will honor their obligations. Participants should use discretion when discussing sensitive information.

9. Individual Coaching

Individual coaching packages and single sessions are purchased separately from the Digital Program. The selected number of sessions, duration, fees, package expiration, scheduling, rescheduling, cancellation and no-show rules are identified in the purchase terms and Services Agreement. Coaching is collaborative; clients remain responsible for decisions and implementation.

10. Adult Clients and Parent or Third-Party Payers

A parent or another person may purchase a service for an eligible adult client. The payer is responsible for payment obligations they separately accept. The adult participant must separately accept the Services Agreement before coaching. Payment does not entitle the payer to course credentials, private coaching information, communications or control over the coaching relationship. Disclosures to parents or third parties require the adult client’s authorization or another lawful basis.

11. No Guarantee; Testimonials

Company does not promise specific grades, academic standing, graduation, accommodation decisions, employment outcomes, behavioral changes or other results. Outcomes vary based on participation and circumstances. Testimonials describe individual experiences and are not guarantees. Company will obtain appropriate prior written authorization before using an identifiable client testimonial, image, recording or coaching information in marketing.

12. Reviews, Social Media and Lawful Speech

Clients may post honest reviews and opinions, including criticism, and may communicate with regulators or participate in legally protected proceedings. Nothing here limits rights under the Consumer Review Fairness Act or other applicable law. Clients may not engage in actionable defamation, infringe Company intellectual property, or unlawfully disclose another participant’s protected private information. Company may seek remedies for unlawful conduct; no prior permission is required simply to identify or truthfully review Company.

13. Privacy and Communications

The separate Privacy Policy explains how Company handles personal information. Company may send messages related to inquiries, sales-call follow-ups, receipts, enrollment, course access, scheduling, service changes, security and other administration. Marketing about new programs or offers is optional; recipients may unsubscribe using the method provided in promotional messages. Opting out of marketing does not prevent necessary transactional or service communications.

14. Third-Party Services and Links

The Site and services may depend on third-party processors and platforms, including Stripe, SignNow, course hosting, scheduling, video conferencing, email delivery and analytics where implemented. Their separate terms and privacy notices may apply. Company is not responsible for independent third-party websites or conduct beyond its control, except where law imposes responsibility. Company will take reasonable steps to address material service interruptions.

15. Prohibited Site Use

Users must not access others’ accounts, impersonate persons, transmit malware, interfere with Site security, scrape or republish protected content, use the Site unlawfully, or harass others. Company may take proportionate protective action and enforce these Terms consistent with applicable law.

16. Disclaimer and Limitation of Liability

The Site is provided on an “as available” basis to the extent permitted by law. Company does not warrant uninterrupted, error-free access. To the fullest extent permitted by law, Company is not liable for indirect, special, incidental or consequential damages resulting from Site use. For purchased services, the negotiated limitation of liability in the signed Services Agreement controls. Nothing excludes liability or statutory remedies that cannot lawfully be excluded, including liability for fraud, gross negligence or willful misconduct where applicable.

17. Disputes; Agreement Priority; Governing Law

Dispute resolution, any binding arbitration agreement, class-action waiver, and applicable liability caps for coaching or program purchases are set forth in the separately signed Services Agreement, if enforceable. These website Terms alone do not impose arbitration on visitors who have not separately agreed to it. If a conflict arises regarding purchased services, the signed Services Agreement controls, subject to mandatory law. New Jersey law governs these Terms except where mandatory consumer laws provide otherwise. Courts with legally proper jurisdiction and venue may hear disputes not subject to enforceable arbitration.

18. Changes, Severability and No Waiver

Company may update these Terms prospectively by posting a new effective date. Changes will not retroactively reduce existing paid contractual rights without legally required consent. If a provision is unenforceable, the remainder continues to the extent lawful. Failure to enforce a provision once does not waive future enforcement.
